In early August 2018, jurors in San Francisco, CA determined that the ingredients in Roundup’s™ weedkiller (glyphosate, etc.) gave a school groundskeeper terminal cancer. They awarded Dewayne Johnson $289 million in damages. Monsanto has long claimed that their product does not cause cancer but the World Health Organization’s International Agency for Research on Cancer found that Roundup™ was “probably carcinogenic to humans” in March 2015. This case was the first significant legal victory over Monsanto. It is estimated that over 4,000 similar cases involving Monsanto’s Roundup™ weedkiller are currently going through the court system.

Dewayne Johnson is 46 years of age and has terminal non-Hodgkin’s lymphoma. As the groundskeeper for a school district near San Francisco, he applied Roundup™ 20 to 30 times a year. In 2012, he had two accidents in which his skin became soaked with Roundup™. Two years later, he was diagnosed with cancer. Lesions cover as much as 80% of his body.

In mounting a defense, the company claimed there were over 800 scientific studies and multiple governmental rulings concluding no relationship between glyphosate and cancer. Clearly someone was lying. Fortunately, Mr. Johnson was able to overcome the mountain of company sponsored studies and prove to the jury that Roundup™ was a “substantial contributing factor” to his illness.

Dewayne Johnson is not expected to live to enjoy the jury’s award but his wife and 2 boys will. Monsanto is appealing the decision but they will have to pay interest on the award (which amounts to $25 million a year) until that process is completed.
